HOLME BUTCHER’S MOTOR INSURANCE

At Lancaster Castle on Saturday, Thomas Todd Atkinson, butcher, Spring Field, Holme, was summoned for exceeding the speed limit of 30 m.p.h. with his van at Ellel on August 1, and for using the van without a policy of insurance being in force, in respect of third party risks, and William Duckett, Holme Farm, Holme, was summoned for aiding and abetting the latter offence.
P.C. Saul said at 6-30 p.m. on 1 August, he was on motor patrol on the main road at Ellel and saw defendant driving a ton van north at a fast rate of speed.  He timed him over 1½ miles and found his speed was 36 m.p.h.  Defendant said he was licensed to carry passengers.  On examining the certificate of insurance he noticed the paragraph “To be used in connection with the policy holder’s business only”.  He pointed this out to Atkinson and asked who the other passengers were.  Defendant said Duckett was a farmer who had been with him to the Royal Show at Preston.  He told him it was Bank Holiday and that could not coincide with business, and further stated that in the event of an accident the insurance company could repudiate liability.  Defendant said to him “I have been with these people to the Royal Show and that is my business”.  He had his mother and son aged 12 with him.
In answer to Mr. Winder (for the defence) witness replied that the speed of 36 m.p.h. was averaged, so that he must have been doing 40 m.p.h. at times, when not held up by traffic.
Mr. Winder: I suggest to you that a butcher is on business when he goes to a show.
P.C. Saul: There is no fat stock there.
Mr. Winder: Of course there is.
P.C. Saul: I mean for a butcher to buy.
Defendant said he knew the police car was behind him because his son told him.  If he had slowed down in the stream of traffic there would have been a congestion.  He had an insurance policy and the certificate covered him.  His motto was “Safety first” and he did not cut out if he could avoid it.
Supt. Edwards: Did you buy any cattle at the show? Witness: I went to view.
The Clerk: Were you on business? – Yes.
Duckett said he went with Atkinson at his request.  He knew nothing about the insurance.
Mr. Winder: You must prove guilty knowledge.  There is no aiding and abetting.
The Bench fined Atkinson 20s. for speeding and £3 for not being insured against third
